Terms of Service

For sake of time and semantics, you -- the consumer -- shall be known as a client from here on out, and I, Denarian Pariseau, will refer to myself as the artist. For sake of time and semantics, these terms of service will be separated into paragraphs relative to each term identified in the following list:

Information about pieces and price adjustments.
Information about custom commissions and how to submit information such as the details of the commission, contact information, and other relevant information such as consent to add the commission to the artist's portfolio.
Information on what is and is not acceptable in a ticket submission, as well as information about ticket submission refusal.

With the acknowledgement of these terms of service, you understand that repeated failure to uphold your responsibilities as a client may result in any progress on ongoing commissions to come to a standstill, completed payments will not be refunded, and you will be blacklisted from not just my own community, but will be warned in others as well.

If a client would like to repost the art either in a private group or publicly online, they must do so with either the watermarked version or with a direct credit to the artist. The client also must make it known to the artist if they would like the piece to be added to the artist's portfolio, if not discussed the artist will assume that the piece is not allowed for publication unless the client either directly posts the piece online or the client gives explicit permission to do so.

Submission of a ticket is defined as:

The client fills out the required form for the commission style they're looking to buy with necessary information such as valid contact information, a description of the commission piece either following the provided guide sheet or various visual images of the character(s) in question, and an email for processing the payment and providing the receipt for purchased services. The client purchasing the corresponding commission shop item (ex: If the client is requesting a chibi icon with a singular figure, they purchase a single figure chibi icon after submitting the form). Please limit three items per commission type; the more a client orders, the longer a commission can be properly processed and completed.

Once a client properly submits a ticket, please keep the order number in mind by either taking a screenshot or saving the email received as a receipt so the artist can cross reference it to both the form submissions and Square website. The artist may ask you to contact them in regards to double checking pose references, submission descriptions, and clarification on certain things to double check and make sure there isn't any misinformation. To contact the artist, either go through Discord, Instagram, or Twitter as they are the best places for the artist to see your message.

The client has fourteen days to reach the artist starting when the submitted ticket is fully purchased. Any submitted forms that do not correspond with Square purchases will automatically be discarded. It is not the artist's responsibility to track down the client, as the client is the one wanting services from the artist, and the artist is not responsible if the client does not reach out. If the client refuses to reach out to the artist after fourteen days, the payment is now considered a non-refundable donation to the artist. Clients are more than welcome to speaking to the artist prior to submitting a ticket, and is highly recommended if the client has any questions about the artist's terms of service.

Different commission bases are listed as their own digital item within the shop, and with each item has its own instructions as to how to properly fill out any additional information required for the ticket submission. Prices will adjust automatically depending on how many commissions you buy per order, however all prices listed on this e-commerce site are fixed when it comes to static options, choices, et cetera. Prices are subject to change in the future, however argumentative behavior and attempts to haggle will not be tolerated.

Payment is 100% done through the POS service Square, an email is required for both reception of the digital good as well as notation receipt information. Personal and private information is not sold or otherwise distributed to large platforms, and a request to delete said information will be followed through in a timely manner. If an order is placed and neither contact information or the description of said commission is missing, there is a grace period of fourteen days (including weekends) before a ticket submission is rejected. Within that grace period, a client is free to reach out to the artist's direct messages with their order number to confirm the purchase of a ticket submission.

Upon completion of a ticket submission, processing and completion is estimated to be around 3-5 days. Daily rate only applies to days that the artist has worked on said commission piece, and is applied to all commission items (ex: three icons with three figures may take two days to complete with one break in between, so only two days are charged on the daily rate for the entire ticket submission). You may receive an invoice in the form of an email containing an itemized list of your purchase, what's been paid and unpaid at the time of the invoice being sent, as well as a preview of the completed commission. When an invoice has been sent out, the client has a grace period of up to fourteen days including a friendly reminder on the seventh as a safety backup to consider the benefit of the doubt.

Should there come an issue out of the client's control within the grace period, and they are unable to pay, negotiations and a payment plan can be made on a case-by-case basis unless the client waits until the very last minute to notify the artist. The latter will be treated as a refusal to pay the daily rate and the commission will not be delivered until the payment is made. Refusal to pay the daily rate will result in the client being blacklisted from further ticket submissions until any outstanding fees are paid in full.

Slightly notated on the Square site for the Idle Character reference listing, the artist has specifically made two lists defining what is and is not allowed to be submitted into a commission ticket, and all of these criteria applies to any kind of commission. The "don'ts" of ticket submission descriptions include the following:

Sexually explicit content of any kind. This includes any kind of pornographic poses where genitalia or female/AFAB presenting nipples are visible. Situations where sexual content is implied depend on the content itself, clients should discuss this with the artist prior to submitting a ticket.
Hate speech. This includes anything promoting racism, ableism, homophobia and LGBTQIA+ oriented hate speech, anti-Semitism, cultural appropriation of any kind, slurs of any kind, and targeted harassment towards one person or a group of people based on race, sexual orientation, culture, or gender identity.
Descriptions of robots or characters with lots of outer armor made of metal.
Problematic content. Numerous topics can be listed for this, however can be lumped into the following categories:
- Paraphilic disorders, defined as having "a sexual desire or behavior that involves another person’s psychological distress, injury, or death, or a desire for sexual behaviors involving unwilling persons or persons unable to give legal consent." This includes the various forms of pedophilia, necrophilia, zoophilia, frotteurism, and exhibitionism among others. For more information on paraphilic disorders, please refer to the Diagnostic and Statistical Manual of Mental Disorders found here.
- Substance abuse, which includes anything implying alcohol or hard drug abuse, directly showing hard drug and/or alcohol abuse.
- Crimes or implications of crimes promoting problematic content, such as child abuse, human trafficking, drug smuggling, domestic altercations, genocide, or crimes centering around hate speech. Though the artist explores dark topics such as these in their personal writing and illustrations, it is in no way an act of glorifying or promoting said crimes.
Actual images of people for reference without their consent or without elaboration. Borrowing hair styles or eye colors from cropped images for reference is allowed, however using an image of a real life person and claiming "this is the character" is not. Pairing this with sexual content or problematic content falls under the category of revenge porn, which is an act of non-consensual sharing of intimate or pornographic images and/or film.

Adversely, the artist has also provided a list of topics that a potential client is allowed to request, and can help give the client a base of what is and is not allowed. The "do's" list of content and topics the artist is willing to draw is as follows:

Gore, provided the specifics do not interfere with prohibited content listed above. This can include body horror, "slasher" themed gore, and inhuman Eldritch abominations that fall under Lovecraftian inspired monstrosities. Tasteful nudity is allowed, however please note that the artist doesn't draw any explicit details regarding genitalia or nipple areas.
Anthropomorphic characters, both mythical themed and reality themed. Be sure to have character references in case the artist asks for more information; the artist is always interested in new and creative ideas.
Original Characters / Fandom Personifications, provided the source material does not interfere with prohibited content listed above. Please be sure to provide examples of source material as well as information about the character itself in case the artist asks for clarifying information.

A client must be sure to communicate with the artist on if the piece is allowed to be shared on social media, credit for the purchase will always be credited and the client will receive both a signed and unsigned version of the piece.

Because no one really wants to read a whole load of TOS shit, I've decided that the best way to do this is to make a condensed version so everyone gets it. If you want more details, go towards the other tabs. Note that all payments are non-refundable and cannot be used for tax write-offs.

Once you choose which submission you want to pay, fill out the form with your email, your general social media contact information and a general description of what you want. After submission, pay the necessary amount on the Square website and DM me a message on social media (Discord is your best bet at a response, as it's the most checked social media account I have). You've got a grace period of two weeks before the ticket is dismissed and the payment is considered as just a donation to Denny's Food and Therapy Fund. Reaching out to me before submitting a ticket is recommended, as it can help clear up any confusion about the terms of service listed

I don't accept any other payments except for ones done through Square, I don't sell private information to anyone, and I'll delete information from Square if asked. Refusal to pay either the base price or the daily rate will result in you bring blacklisted and your ticket being rejected. I understand that things come up sometimes, and you've got a grace period of 2 weeks if an issue comes up with payment.

I don't draw sexually explicit content, substance abuse, problematic content, or highly detailed robotic pieces. Gore's all on the table, and my personal favorite is Lovecraftian body horror and meaty gore. If you request a piece that involves anything on my "do not draw" list, you will be automatically blacklisted.
